Shiney Ahuja is likely to stay behind bars as his bail application has been rejected by the session court. Arrested on June 14 for allegedly raping his domestic help at his residence; Shiney has been since behind the bars.

The court rejects Shiney's bail plea on the grounds of the crime being a serious offence and hence have made a prima facie case against the actor.

Shiney's lawyer Shrikant Shivade argued that "consensual sex" is being misinterpreted as Rape and claimed that the alleged victim is 'aggressive' in nature, as she belongs to a 'lower caste'. He further argued Shiney has been wrongly implicated and he hails from a 'respectable' family.

Shrikant Shivade elaborated on his 'consensual sex' theory and said, "The maid belongs to a lower caste, which is aggressive by nature, and she wouldn't have submitted herself so easily. They are known for being aggressive."

As expected Shrikant Shivade arguments did not hold water; and the court dismissed defence arguments in favour of medical reports, which made the 'consensual sex' theory doubtful.

Shiney is booked under section 376, which states that if a married man is sexually-indulged with a woman misguiding her with promise of marriage; it will amount to rape under section 376 of IPC. So Shiney will now remain in remand till July 16.

Shiney's lawyers are planning to move an appeal against the order in the Bombay High Court.
