Sushmita had complained demanding payment of a hefty 1,38,000 US dollars as fees for her performances at the Heat shows in the US, UK and Dubai in May 2006. The shows had been produced by Safdar Hussain and co-coordinated and directed by Abu Malik.
Ashok Sarogi and S K Punder defended Malik and Bachubhai Munim & Co. represented Sushmita.
Abu Malik confirmed that he had won the case. "I am very happy. I was clear from the beginning that I didn't have to pay Sushmita anything."
Malik added, "We had 20 hearings before we reached a conclusion. I had to undergo mental torture for two-and-half years. Sushmita didn't attend the hearings, her sister Neelam used to come. However, I went for all the hearings."
Malik had consistently maintained that he owed no dues to Sushmita. According to Abu, Sushmita was supposed to do only 11 shows on the Heat tour. But later, she categorically demanded a huge amount for 15 shows in advance and threatened to pull out from the tour if she was not paid the same. "The shows were not doing well and Sushmita had even agreed to return the excess money that we'd paid her at that time. Now, she's demanding money from me saying that she's been underpaid. This is ridiculous," he had said then.
